Neutral Citation No. - 2025:AHC-LKO:16111-DB Court No. - 2 Case :- WRIT - C No. - 2613 of 2025 Petitioner :- Shambhu Mishra And 4 Others Respondent :- Addl. Commissioner (Administration) Ayodhya And 10 Others Counsel for Petitioner :- P.K. Mishra Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. There is a dispute between the petitioners, opposite party no. 6 and other private parties. Some partition decree is said to have been passed under Section 176 of the U.P. Z.A. & L.R. Act, 1950. An application for restoration was filed by the petitioners which has been dismissed as time barred against which an appeal has been filed, which as informed by Ms. Akansha Dubey, learned Chief Standing Counsel is listed before the Appellate Court on 07.04.2025. In the interregnum, the Revenue Authorities, as alleged by the petitioners, want to implement the partition decree. We fail to understand as to how in these circumstances a writ petition under Article 226 of the Constitution of India is maintainable. The petitioners may seek such relief as is permissible in the pending appeal before the Appellate Court. The writ petition is accordingly disposed of.
