Neutral Citation No. - 2025:AHC-LKO:17223 Court No. - 6 Case :- WRIT - C No. - 2560 of 2025 Petitioner :- Santosh Kumar Respondent :- State Of U.P. Thru. Prin. Secy. Food And Civil Supply U.P. Lko. And 3 Others Counsel for Petitioner :- Suresh Chand Rathour,Dilip Kumar Pandey Counsel for Respondent :- C.S.C.,Dilip Kumar Pandey Hon'ble Pankaj Bhatia,J.
1. Heard learned counsel for the petitioner and learned Standing Counsel.
2. The present petition has been filed challenging an order dated 14.02.2025, whereby the claim of the petitioner for being appointed as fair price shop license holder on compassionate ground has been rejected.
3. Admittedly, the petitioner is the nephew of the license holder. It was claimed by the petitioner that the license holder was blind and the petitioner used to help him. It is also claimed that the petitioner was granted a Will in his favour by the license holder and thus for all practical purposes, the petitioner was staying with the license holder. Thus, he should have been considered for appointment on compassionate ground.
4. Learned Standing Counsel draws my attention to the G.O. dated 05.08.2019, where the definition of the family is prescribed, which does not include the nephew with the list of persons, who are entitled to apply for licence on compassionate ground. This issue was considered and decided by this Court in Writ-C No.2695 of 2025.
5. As admittedly, the petitioner does not fall within the definition of family as described in the G.O. dated 05.08.2019, there is no error in rejecting the said application. The petition cannot be entertained and is, accordingly, dismissed. Order Date :- 26.3.2025 Ashutosh Digitally signed by :- ASHUTOSH PANDEY High Court of Judicature at Allahabad, Lucknow Bench
