THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.3258 OF 2025 ORDER: 1. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as A.1 in Crime No.373 of 2024 of Kanchikacherla Police Station, NTR Commissionerate, registered for the alleged offence under Sections 329(4), 109(1), 351 (2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. The learned counsel further submits that this Court granted pre-arrest bail to all the accused, except the petitioner herein. Insofar as the petitioner is concerned, his bail application was dismissed. The counsel further submits that there is political rivalry between the petitioner’s group and the complainant’s group. The injuries allegedly sustained by the 2nd respondent are simple in nature, and hence, the provisions under Section 109(1) of the Bharatiya Nyaya Sanhita, 2023, do not apply to the present facts of the case. 4. Considering the same, this Court deems it appropriate to dispose off the criminal petition, by directing the Station House Officer, Kanchikacharla Police Station, NTR Commissionerate, to complete the investigation in 2 Crime No.373 of 2024, without taking coercive steps against the petitioner. This would not preclude the investigating officer to file charge sheet/ final report. 5. Accordingly, the criminal petition is disposed off. 6.
