Neutral Citation No. - 2025:AHC-LKO:16126 Court No. - 18 Case :- WRIT - A No. - 2961 of 2025 Petitioner :- Dr. Meenakshi Saxena Respondent :- State Of U.P. Thru. Addl. Chief Secy. Prin. Secy. Medical. Health And Family Lko. And 3 Others Counsel for Petitioner :- Jai Bahadur Singh Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Vakalatnama filed by Shri Syed Mohammad Haider Rizvi on behalf of respondent No.4 is taken on record. Heard learned counsel for the petitioner, Shri S.P. Singh, learned Additional Chief Standing Counsel for State-respondent Nos.1 to 3 and learned counsel for respondent No.4. It is not disputed between the parties that this is the third successive writ petition on behalf of the petitioner. By this petition, the petitioner while praying relief No.2 has prayed for punishing the respondents for flouting the judgment and order dated 31.01.2025 passed by this Court in Writ-A No.1416/2025 inasmuch as the order has not been complied with. Learned counsel for respondent No.4 has submitted that pursuant to the judgment and order dated 31.01.2025 (supra), no objection certificate has been issued in favour of the petitioner and she has also participated in the counseling which has been held in compliance of the said judgment and order dated 31.01.2025. Learned counsel for the petitioner has disputed this statement given by the respondent No.4 and has submitted that no counseling after 31.01.2025 has taken place. Rebutting the same learned counsel for respondent No.4 has provided written instructions to this Court which is taken on record. A perusal of the instructions shows that at page no.9 vide notice dated 03.03.2025 information was given to the incumbents for opening portal in U.P. NEET P.G. Examination-2024. The counseling was scheduled to be held on 04.03.2025 and 06.03.2025. The instructions further shows that result of the counseling has also been published wherein the petitioner's name finds place at Sr. No.2580 who has secured All India Rank 8980. The instructions given are taken on record. Perusal of the record further shows that submission of learned counsel for the petitioner that no counseling has taken place after the judgment of this Court dated 31.01.2025 is false. Not only this, the petitioner has suppressed the material facts and has mislead the court. The record clearly shows that petitioner has participated in the counseling held pursuant to the notice dated 03.03.2025 and has secured All India Rank of 8980 thus, the writ petition is dismissed on account of suppression of material facts. Accordingly, the writ petition is dismissed. Order Date :- 20.3.2025 Saurabh Yadav/- Digitally signed by :- SAURABH YADAV High Court of Judicature at Allahabad, Lucknow Bench
