Order on IA-01 of 2025: Heard Sri Anil Kumar Tripathi, the learned counsel for the applicant, Sri Satyendra Srivastava, the learned A.G.A. for the State and perused the records. This is an application seeking withdrawal of an amount of Rs.25,000/- deposited in this court in compliance of order dated 20.03.2023. By means of order dated 20.03.2023, this court had stayed the operation of the cognizance and summoning order dated 02.03.2019 after recording that there is a matrimonial dispute between the parties which may be resolved through the process of mediation and the applicant was directed to deposit Rs.25,000/- in this court. The proceedings between the parties have been disposed of in terms of an order dated 25.09.2024, passed by the Hon'ble Supreme Court in Transfer Petition (Criminal) No.409 of 2024, wherein the parties have entered into a settlement agreeing for closure of all the proceedings. The amount agreed to be paid by the applicant has already been paid by him to the private opposite party. In view of the aforesaid order passed by the Hon'ble Supreme Court, the application under Section 482 Cr.P.C. has become infructuous and it is dismissed as such. The amount of Rs.25,000/- deposited by the applicant in compliance of order dated 20.03.2023 be refunded to him within a period of one month from the date he completes necessary formalities. .
