This petition under Section 483 of BNS, 2023 is preferred to enlarge the petitioner on regular bail in Crime No.424/2024 of Annapoorneshwari Nagar Police Station, Bengaluru City, registered for offences punishable under Section 109, 329(4), 352 of BNS, 2023. 3. A perusal of the complaint lodged by Prema Kumari C W/o. Vinod, reveal that on 13.11.2024 at about 2.00 p.m., Usaman and Raghu (accused) came near her house and started shouting in vulgur words, as a car was parked in front of their house near the garage of the - 3 - NC: 2025:KHC:7711 CRL.P No. 260 of 2025 accused. The complainant to protect herself, brought a knife from the kitchen and threw it outside the gate and when her father-in-law and son-in-law went near the gate and pushed the accused with a helmet, accused picked the knife and stabbed complainant's father-in-law. 4. The incident is on account of a petty quarrel, which took place when the accused came and objected the complainant for parking the car in front of their house, near the garage where he was working. The complaint averments reveal that, complainant brought a knife from the kitchen and threw it outside and when her father-in- law i.e., the injured tried to push the accused with a helmet, the helmet fell down and while he was bending to take the helmet, accused picked the knife and stabbed him on his back. 5. It prima facie shows that the incident is on account of a sudden quarrel. Accused was not armed with a weapon, when he came near complainant's house. The complainant has alleged that the accused was drunk and - 4 - NC: 2025:KHC:7711 CRL.P No. 260 of 2025 when he started shouting and hurled abuses at her, she brought a knife from her kitchen and threw it outside the gate. It is only when the injured tried to push the accused with a helmet, probably, due to provocation, he picked the knife and stabbed him. 6. The learned Sessions Judge while dismissing the bail petition has observed that knife has to be recovered from the accused. However, the material on record shows that the knife was seized from the spot. Injured has been discharged from hospital. At this stage, it cannot be said that the accused had any intention to do away with the life of injured. He is in custody since 14.11.2024. He has no bad antecedents. Hence by imposing conditions, he can be admitted to bail. Accordingly, the following: O R D E R i) Petition is allowed. - 5 - NC: 2025:KHC:7711 CRL.P No. 260 of 2025 ii) Petitioner/accused in Crime No.424/2024 of Annapoorneshwari Nagar Police Station, Bengaluru City, is ordered to be enlarged on bail, subject to following conditions: 1. He shall execute a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties for the likesum to the satisfaction of the jurisdictional Court. 2. He shall furnish proof of his residential address and shall inform the Investigation Officer, if there is changes in the address. 3. He shall mark his attendance at the jurisdictional Police Station on every saturday between 10.00 a.m., to 1.00 p.m., till filing of the charge sheet. 4.
