Misra, learned counsel for the petitioner, on the basis of instructions, submit that FIR was lodged against the husband of the detenue by the father of the detenue. In pursuance thereof, the statement under Section 164 Cr.P.C.of the detenue was recorded and in pursuance thereof, she has gone with her husband and residing with her husband i.e. next friend of the detenue. In view of above, at this stage, he does not want to press this petition with liberty to approach again in case the occasion arises. To which there is no objection by Shri Vinay Kumar Shahi, learned A.G.A. The petition is dismissed as not pressed with liberty as prayed for.
