[2025:RJ-JP:23696] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 4221/2025 Arun Sharma S/o Shri Brajesh Sharma, Aged About 40 Years, R/o Brajesh Vila, Shiv Mandir Ke Samne Wali Gali, Lal Kothi, Jaipur. ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : None Present For Respondent(s) : Ms. Manju Dave, PP HON'BLE MR. JUSTICE SUDESH BANSAL (V. J.) Order 27/06/2025
1. None appears for petitioner.
2. Instant anticipatory bail application under Section 482 of BNSS has been filed by petitioner, apprehending his arrest in FIR No.264/2022 registered at Police Station Bagru, District Jaipur (West), for the offences under Sections 420, 467, 468, 471, 447, 427, 379 and 120-B IPC.
2. Heard learned Public Prosecutor and perused the material available on record.
3. From perusal of FIR and impugned order, it appears that petitioner has been stated to be an officiating Member of Badanpura Grah Nirman Sehkari Samity and involved in creating a forged patta and to grab crores of rupees from the innocent persons. Further, petitioner has criminal antecedents and he has
[2025:RJ-JP:23696] (2 of 2) [CRLMB-4221/2025] been booked in as many as three criminal cases, as detailed out in Para No.6 of the impugned order of trial Court.
4. It is trite law that anticipatory bail can be granted in exceptional circumstances where the court is prima facie of the view that the applicant has falsely been involved in the crime and would not misuse his/ her liberty. Such proposition of law has been expounded by the Hon’ble Supreme Court in cases of Jai Prakash Singh Vs. State of Bihar [(2012) 4 SCC 379] & State of Madhya Pradesh Vs. Pradeep Sharma [AIR 2014 SC 626].
5. This Court finds it difficult to discern, at this stage, whether the accused-petitioner has falsely been implicated in the present matter or the case of present petitioner falls under any of the exceptional circumstances, as laid down by the Apex Court in afore-referred cases, more particularly when the matter is under investigation. In such totality of facts & circumstances, this Court is not inclined to grant the benefit of anticipatory bail to petitioner.
6. As a result, the present anticipatory bail application is hereby dismissed.
