Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as an accused in Crime No. 641 of 2022, of Ongole Taluk Police Station, Prakasam District, registered for the alleged offence under Sections 509 and 506 of the Indian Penal Code, 1860. 3. It is alleged in the complaint that the petitioner threatened the 2nd respondent by making phone calls and also posted abusive content on social media against the political leaders. 4. The learned counsel for the petitioner submits that on account of political rivalry, the 2nd respondent filed a false complaint against the petitioner. The learned counsel further submits that the offences alleged against the petitioner are punishable below 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 5. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Ongole Taluk Police Station, Prakasam District, is directed to follow the procedure as contemplated under 3 Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 for the purpose of investigation in connection with Crime No.641 of 2022. 6.
