(Oral) The applicant is in judicial custody in FIR No.25 of 2024, dated 15.08.2024, under Sections 419, 420, 120-B, 34 IPC and Section 66-D of the INforamtion Technology Act, 2000, Police Station Cyber Crime, Rudrapur, District Udham Singh Nagar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. Learned counsel for the applicant would submit that there is no evidence against the applicant; moreover, it is argued that at the time of arrest, the memo of arrest has not been communicated to him in writing. 4. Learned State counsel would submit that it is a case of cyber fraud, in the name of stock market trading 2 the informant was induced to invest money. The informant invested `53 Lakhs in two bank accounts that were given in the FIR. One of the accounts is in the name of one Prem Shankar and in that Prem Shankar’s gmail- ID recovery and phone user number of the applicant is recorded. 5. The Court posed a question to the learned State counsel that, if in the gmail-ID of co-accused Prem Shankar, the recovery and phone user number of applicant is given how it makes the applicant complicit in the offence? There is no answer to it. 6. Admittedly, no money was deposited in the account of the applicant. 7. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 8. The bail application is allowed. 9. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
