Through this petition, the petitioner has prayed for the following relief:- "Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to direct the Learned Trial Court i.e. Additional Chief Judicial Magistrate/ FTC Court No. 48 Barabanki to decide the trial of Complaint Case No. 2769/2023 under section 138 of NI Act, 1881 Police Station-Kotwali Nagar, District-Barabanki (titled as Siddhi Enterprises Vs. Maa Durga Brick Field) expeditiously within stipulated time as framed by this Hon'ble Court, in the interest of justice. Any other order or direction which this Hon'ble Court deem fit and proper under the circumstances of the case may also be pass in favour of the petitioner, in the interest of justice." Learned counsel for the petitioner submits that the case under Section 138 N.I. Act was filed in the year 2023. The proceedings are going on at a very slow pace. Perused the record. On due consideration to the submissions advanced and perusal of the record, the petition is disposed of with a direction to learned court below to make an endeavour to decide the complaint case filed under Section 138 N.I.Act as per the provisions of Section 143 (3) N.I.Act.
