JUSTICE MRIDUL KUMAR KALITA ORDER Date : 15.10.2025 1. Heard Mr. B. Borah, the learned counsel for the applicant. Also heard Mr. R. K. Jain, the learned counsel for the respondent. 2. This application under Order 22 Rule 4 of the Code of Civil Procedure, 1908 has been filed by the applicant for substitution of the legal heirs of the deceased – respondent No.2 in the connected Civil Revision Petition (IO)/437/2024. 3. It is submitted by the learned counsel for the applicant that though, the instant case was abated on the death of the respondent No.2, however, the said abatement has been set aside in this case by order dated 15.10.2025 in I.A. (Civil)/1756/2025, he further submits that the names of the legal heirs of the respondent No.2 has been stated in paragraph No. 5 of the substitution application. 4. Considering the grounds mentioned in the said petition, this Court is inclined to allow the substitution petition. 5. Accordingly, the names of the legal heirs of the respondent No. 2, namely, (a) Kaustavee D Sarmah, wife of the deceased – respondent No.2, (b) Miss Jaishnavi Gautam, daughter of the deceased – respondent No.2, and (c) Mater Ranveer Gautam, son of the deceased – respondent No.2 may be substituted as the respondent Nos. 2(a), 2(b) and 2(c) respectively, in the connected Civil Revision Petition (IO)/437/2024 6. The applicant is directed to submit an amended cause title incorporating the name of the substituted respondents in the said amended cause title. Page No.# 4/4 7.
