GP FOR IRRIGATION COMM AREA DEV The Court made the following: 3 VS, J W.P.No.7807 of 2023 ORDER: This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: “….to issue a Writ/Order/ Direction more particularly one in the Nature of Writ of Mandamus declaring the action of the Respondents in not considering the representation dt.10.10.22 for implementation of orders in W.P.No.7058/19 passed on the file of this Hon'ble Court as illegal, arbitrary, without jurisdiction besides violation of Art.14 of the Constitution of India and consequently direct the respondents to consider the representation dt.10.10.2022 of the petitioner for removal of obstructions to Natural Course in the village forthwith…” 2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Irrigation. 3. Today when the matter came up for hearing, learned Assistant Government Pleader for Irrigation has furnished a copy of the letter addressed by the Executive Engineer, VGP Division, Markapur, dated 18.08.2025 to the petitioner which is in pursuance of the orders passed by this Court in W.P.No.7058 of 2019 as well as the subsequent representation made by the petitioner on 10.10.2022, wherein it is stated that to supply water 4 VS, J W.P.No.7807 of 2023 to the Kanigulakunta Cheruvu, the Executive Engineer, VGP Division, Markapur has given final notice to the working agency to resume the work to supply water to the said Cheruvu. Recently, farmers of the ayacut of Kanigulakunta Cheruvu represented that, by widening Stream-1, sufficient amount of water can be discharged to the said Stream-1. But, the said Stream-I is in the area of Reserve Forest which is not handed over by the Forest Department. Under these circumstances widening of Stream-1 is not possible without acquiring the said land from the Forest Department. It is further stated that removal of earth bund and restoring the stream will be done after following due procedure and as such requested two months time for restoring the stream. 4. Recording the same, instead of keeping the writ petition pending, this Court feels it appropriate to dispose of the writ petition by directing the respondents to restore the stream, as expeditiously as possible, preferably within a period of four (4) months from the date of receipt of a copy of this order. 5. Accordingly, the Writ Petition is disposed of.
