The present application has been filed by the Petitioner under Section 47 of the Code of Civil Procedure, 1908 seeking the following reliefs:- “It is most humbly prayed that in the light of ground 1- 3 of this application, the Hon’ble Court will graciously be pleased to hold that the impugned order in WP 3379/2025 neither discharge the WP nor the order can be executed unless there is a legitimate Management Committee in the Society to consider the membership application of the applicant and modify the orders dated 19.03.2025 directing the respondent no. 3 to ensure a Management Committee in the Society constituted as per DCS Act and Rules and bye-laws of the society and Supply a copy of the bye-laws of the society that the society itself follow for its election and for other purposes to petitioner. or pass as such other orders as may be deemed fit in the circumstances of the case. Vide order dated 19th March, 2025, this Court had observed that the Petitioner is entitled to membership of the Mother Diary Employees Cooperative Group Housing Society, subject to the clearance of dues and upon the said dues being cleared, the membership shall be granted within one month. 4. The present application again seeks a direction to Respondent No. 3– Mother Dairy Employees CGHS Ltd. to ensure that there is a legitimate Management Committee because it is the submission of the Applicant that unless there is a legitimate Management Committee, the dues cannot be recovered from him. 5. At this stage, the applicant who appears in person submits that he wishes to withdraw the present application. 6. Accordingly, the application is dismissed as withdrawn. PRATHIBA M.
