1. This is the second bail application filed by the applicant. The first bail application of the applicant has been dismissed on merits vide order dated 13.12.2024, which was passed in MCRC No.7957 of 2024.

Learned counsel for the applicant would submit that till date only three witnesses have been examined and final adjudication of the case will take its own time. The applicant is in jail since 15.05.2024 and trial of
2 the case is not in considerable progress. Therefore, he has filed the second bail application.
3. On the other hand, learned counsel for the State opposes and has submitted that out of total 7 witnesses three witnesses have already been examined and the trial of the case is in progress, therefore, the applicant is not entitled for bail.

Considering the submissions made by the learned counsel for the parties and considering the nature of the allegation and that the first bail application of the applicant has been dismissed on merits on 13.12.2024 and out of 7 witnesses three witnesses have already been examined, therefore, I am not inclined to consider it to be a change of circumstance and therefore, his second bail application is accordingly, rejected.
