Though Sri Tripathi has filed the listing application but the State Government has already filed the short counter affidavit indicating therein that the police report has been filed in the present case, therefore, there is no purpose to keep this petition pending any longer inasmuch as the prayers prayed in the writ petition may not be granted as those have been rendered infructuous. 3. Accordingly, the writ petition is dismissed being infructuous. 4. However, it is always open for the parties to take appropriate remedy available with them before appropriate court of law, if they are aggrieved. 5. Consigned to the record. 6.
