So far as the above Special Appeal is concerned, it is seen that the basis for termination of the appellant-writ petitioner’s service is the communication dated 17th August, 2016 issued by the Registrar, Education Regulatory Authority, Uttar Pradesh, Allahabad, wherein it is stated that Enrolment No. 828 of L.T. Examination, 1999 from Sakaldiha Training College, Sakaldiha, Varanasi does not belong to the petitioner, rather it belongs to one Rajvir Singh, son of Sri Padadhar Singh. In the absence of challenge to this foundational fact, we are unable to comprehend as to how any relief can be granted to a consequential order of removal, which admittedly, is premised on the opinion of the University. 2025:UHC:6748-DB 2 2. It is also not in dispute that the letter dated 29.10.2020 was issued pursuant to an inquiry conducted by the SIT constituted for unearthing such unjustified / illegal appointments. 3. In that view, learned counsel for the appellant prays leave to withdraw the instant Special Appeal with liberty to file fresh petition calling in question the letter of the Registrar, Education Regulatory Authority, Uttar Pradesh, Allahabad dated 17.08.2016. 4. Reserving such liberty, the instant Special Appeal is dismissed as withdrawn. 5. There shall be no order as to costs. 6. Pending application, if any, also stands dismissed. _______________ G.
