Neutral Citation No. - 2025:AHC-LKO:21468-DB Court No. - 2 Case :- WRIT - C No. - 2608 of 2025 Petitioner :- Abdul Aziz Respondent :- Managing Director, Madyanchal Vidut Vitran Nigam Ltd. Lko. And 2 Others Counsel for Petitioner :- Vijay Kumar Asthana,Harish Tripathi,Peeyush Mishra Counsel for Respondent :- Aprajita Bansal Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard learned counsel for the petitioner and Ms. Surbhi Rawat holding brief of Ms. Aprajita Bansal, learned counsel for the Electricity Corporation. On 24.03.2025 we had passed the following order:- "Heard. The petitioner says that he had been granted valid connection, which has been disconnected illegally on the ground that somebody else was the owner of the premises and the connection was in his name. On being asked to show the document by which connection was granted to him, as of now the petitioner was unable to show the same. Counsel for the Electricity Corporation says that the petitioner was illegally granted connection whereas the sale deed, etc. was in the name of another person who, in fact, earlier had been granted a connection which was removed illegally by the petitioner. As prayed by learned counsel for the Electricity Corporation, list this case on 16.04.2025 as fresh enabling her to seek instructions in the matter. It is open for the concerned opposite parties to file affidavit in response to the Writ Petition." Today, Ms. Surbhi Rawat holding brief of Ms. Aprajita Bansal, learned counsel for the Electricity Corporation has instructions to inform the Court that all dues pertaining to the premises in question have been cleared, therefore, there is no impediment in considering the application of the petitioner for grant of new electricity connection in respect thereof, however, for this he will have to submit an application as per rules along with indemnity bond as per Clause 4.4 of the U.P. Electricity Code, 2005. She further says that petitioner would only be given prepaid electricity connection. Learned counsel for the petitioner has no objection in this regard, therefore, he should submit an application as aforesaid and as soon as it is submitted, the opposite party no. 2 shall act upon the same and consider the grant of new electricity connection in respect of the premises in question as per rules and if there is no further impediment, the same shall be taken to its logical conclusion at the earliest, say, within a period of three weeks. With the aforesaid observations/directions, the writ petition is disposed of. . (Om Prakash Shukla,J.) (Rajan Roy,J.) Order Date :- 16.4.2025 R.K.P.
