Ms. Ananya Jain, learned counsel holding the brief of Mr. Sandeep Kothari, learned counsel for the petitioner in the connected writ petition. 3. Mr. Shubhang Dobhal, learned counsel for the respondents. 4. The petitioners are praying for the following reliefs in both the writ petitions: “i. Issue a writ, order or direction in the nature of certiorari quashing the impugned order no. REG/DC/DIC/SR.A.O./2022/907 dated 21.10.2022 passed by respondent no. 1 by which the petitioner has been debarred for two semesters i.e. I and II semesters of academic year 2021-22 for using unfair means during semester final examination of II semester of Second Year course of B.Tech. (Industrial and Production Engineer). (Annexure no. 1 to this petition). ii. Issue a writ, order or direction in the nature of mandamus directing the respondents to impose the penalty as previously in similar situation the university was pleased to relax the said punishment by giving him an alternative punishment of Rs. 25,000/- and giving him a chance of reform not creating any question mark or blot in the academic career by imposing a monetary penalty and saving the academic career, else the petitioner shall suffer irreparable loss and injury and the same cannot be compensated by any means.” 5. The subject matter of both the matters are identical. 6. Learned counsel for the petitioners submits that the issue as raised in both the writ petitions are squarely covered by the judgment rendered by the Coordinate Bench in WPMS No. 1612 of 2023 and WPMS No. 1650 of 2023 decided on 02.11.2023. 7. Learned counsel for the respondents Mr. Shubhang Dobhal, who appears for the University, also fairly submits that the issue as raised in these petitions are squarely covered by the aforesaid judgment passed by the Coordinate Bench. 8. In view of the submissions as advanced by both the counsels, the present writ petitions are disposed of in terms of the judgment rendered by the Coordinate Bench dated 02.11.2023 passed in Writ Petition No. 1612 of 2023 ‘Dipesh Phulera vs. G.B. Pant University of Agriculture and Technology, Pantnagar, District Udham Singh Nagar, and Others’ and WPMS No. 1650 of 2023 ‘Himanshu Raj vs. G.B. Pant University and Others’.
