Heard learned counsel for petitioner, learned State Counsel for opposite parties 1 to 3. In view of order being passed, notice to opposite party No.4 stands dispensed with. 2. Petition has been filed seeking a direction to the concerned authority to conduct free and fair elections for the Board of Management of Alakhnanda Enclave Residents Welfare Association Awadh Vihar Yojna Lucknow in terms of registered bye laws dated 5th July, 2018 and the U.P. Apartment (Promotion of Construction, Ownership and Maintenance) Rules, 2011. 3. It has been submitted that by means of order dated 27th February, 2025, the election schedule has already been published indicating the procedure to be held from 17th March, 2025 till 23rd March, 2025. 4. Learned counsel for petitioner on the basis of instructions submits that he does not challenge the aforesaid election programme but restricts his right with regard to the prayer so made. 5. Learned State Counsel appearing for opposite parties submtis that the elections notified would definitely be followed in accordance with statutory provisions and bye laws of the Association. 6. Considering aforesaid facts and circumstances, the opposite party No.3 i.e. Deputy Registrar, Firms, Societies & Chits, Uttar Pradesh, Lucknow is directed to hold the elections as notified vide order dated 27th February, 2025 in accordance with law. 7. With the aforesaid directions, the petition stands disposed of.
