Counter affidavit filed by learned AGA is taken on record. Heard learned counsel for the petitioners and learned A.G.A. for the State and perused the material available on record. This writ petition has been filed for the following reliefs : "(i). issue a writ, order or direction in the nature of certiorari for quashing the First Information Report dated 02.03.2025, lodged by the petitioners at Police Station Lalganj, District Pratapgarh as Case Crime No.65 of 2025 dated 02.03.2025 under Sections 109(1), 115(2), 352, 351(3) BNS in Annexure no. 1 to this writ petition ; (ii). issue a writ order or direction in the nature of mandamus commanding the opposite parties not to proceed, prosecute or arrest the petitioners on the basis of the First Information Report dated 02.03.2025, lodged by the petitioners at Police Station Lalganj, District Pratapgarh as Case Crime No.65 of 2025 dated 02.03.2025 under Sections 109(1), 115(2), 352, 351(3) BNS in Annexure no. 1 to this writ petition." In para no.17 of the counter affidavit filed by learned AGA, it has been stated that sufficient evidence has been collected against the petitioner, therefore charge sheet has been prepared on 09.04.2025 and submitted before the supervisory authority. In view of the above, this Court finds it inappropriate to interfere and quash the FIR as prayed for. The writ petition is dismissed.
