The instant petition has been preferred seeking following main relief:- "Direct the Learned Court of Additional Commissioner Lucknow Division, Lucknow in case no. 2633/2015 (Shambhu Dayal Vs. Subhagi), U/s-219 of UP Revenue Code 1901, which has been dismissed for want of prosicution, thereafter the the recall application has been filed by the opp. party No.2 & 3 and the same is pending from 2020, decide within stipulated period." Taking note of the facts and circumstances of the case and period of pendency of the application in issue, this petition is disposed of with a direction to the Authority concerned to consider and decide the application in issue pending in case No. 2633/2015 (Shambhu Dayal Vs. Subhagi) most expeditiously after affording full opportunity of hearing to the parties to the litigation and without granting unnecessary adjournment to either party, say within a period of six months from the next date fixed in the case, if there is no other legal impediment in this regard. It is made clear that the Court has not examined the case of either party on merits and the Authority concerned shall be free to decide the matter strictly in accordance with law.
