CRM-M-1911-2025 (O&M) Date of Decision: 28.03.2025 Imran
.....Petitioner Versus State of Haryana .....Respondent CORAM:
HON'BLE MR. JUSTICE MAHABIR SINGH SINDHU Present: Mr. Munfaid Khan, Advocate for the petitioner. Mr. Neeraj Sheoran, DAG, Haryana. **** MAHABIR SINGH SINDHU
, J.
Present petition has been filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of bail pending trial to the petitioner in FIR No.358 dated 15.10.2024, registered under Sections 21 (b), 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act'), at Police Station Sarai Khawaja, District Faridabad. 2. Allegations are that petitioner was nominated on the disclosure suffered by co-accused, namely, Jitender @ Jeetu & Vikash from whom alleged recovery of 10.25 grams of heroin (non-commercial) was effected. 3. Contends that petitioner is in custody since 20.10.2024 and co- accused, namely, Sharaft, Jitender @ Jeetu and Vikash with similar allegations have already been granted bail pending trial by this Court on 17.01.2025, 31.01.2025 and 10.02.2025, respectively. Also contends that petitioner is not named in the FIR; rather nominated on the basis of disclosure made by co-accused, namely, Jitender @ Jeetu and Vikash. Lastly contends that there is no other criminal case pending against the petitioner. 4. Learned State counsel, on instructions, has acknowledged the above factual position, but opposed the prayer on the premise that HARISH KUMAR 2025.03.28 16:37 I attest to the accuracy and integrity of this document
CRM-M-1911-2025(O&M) 2 allegations against the petitioner are serious in nature and he is the supplier of alleged contraband. 5. Heard both sides and perused the paper-book. 6. Concededly, petitioner is in custody since 20.10.2024. It is also not in disputed that co-accused, namely, Sharaft, Jitender @ Jeetu and Vikash with similar allegations have already been granted bail pending trial by this Court on 17.01.2025, 31.01.2025 and 10.02.2025, respectively and there is no challenge to the orders till date by the State. Also recovery effected from co-accused is non-commercial in nature. As the conclusion of trial will take sufficient long time; therefore, further incarceration of the petitioner would not serve any purpose. 7. Consequently, present petition is allowed; petitioner shall be admitted to bail on furnishing bail/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. 8.
Petitioner shall appear on each & every date of hearing and to fully co-operate with learned trial Court without seeking any unnecessary adjournment(s). 9. The above observations be not construed as an expression of opinion on the merits of the case, in any manner. 10. It is clarified that in case there is recurrence or any misuse of concession of bail on the part of the petitioner, State would be at liberty to move an appropriate application for recalling of this order. Pending application(s), if any, shall also stand disposed off. 28.03.2025 (MAHABIR SINGH SINDHU) Harish Kumar
