This writ petition is filed declaring the action of Respondents in not releasing Rs.91,573/- as illegal and arbitrary, even though the Petitioner had completed the works assigned. 2. The case of the Petitioner is that he is a civil contractor and Respondent No.3 had issued notification inviting tenders or quotations for repairing full length fabrication work to Tractor Trailer No.AP 16 TA 8375. 3. Pursuant thereto, the Petitioner made his bid and being a lowest tenderer, the works were allotted @ of Rs.94,788/- and accordingly an agreement was executed between the Petitioner and Respondent No.3 on 15.11.2022. Though the Petitioner claims to have completed the work and submitted bill for payment of gross amount of Rs.94,788/-, the said bill was passed at net amount of Rs.91,573/- after adding GST at the rate of 18%. Though the bill was passed, no amount was being disbursed to the Petitioner. Hence, the present writ petition is filed. 3

Learned standing counsel for Respondent No.3 passed on signed instructions of the Commissioner, Gudivada Municipality, wherein it is stated that basing on the adverse newspaper clippings published on 27.01.2023 in Andhra Prabha, Eenadu, the Commissioner and Director of Municipal Administration has instructed the Regional Director-cum-Appellate Commissioner, Municipal Administration, Rajamahendravaram on 09.05.2024 to examine, enquire the list of 69 contingent items and furnish detailed report for taking further action. 5. Pursuant thereto, the Regional Director-cum-Appellate Commissioner had instructed the Municipal Commissioner, Gudivada to constitute an expert committee with members constituting Accounts Officer, Municipal Engineer, Assistant Commissioner, Town Planning Officer to examine whether the work bills are genuine or not. Upon instructions, the Municipal Commissioner, Gudivada Municipality constituted an expert committee on 13.12.2024 vide Roc.No.535/2024/C1 to verify the genuineness of the work bills submitted by the Petitioner and others.
It is further stated that after the report is received from the expert committee, further action will be taken for payment of

amounts to the Petitioner. However, the instructions do not provide for any time limit to the expert committee for submitting the report. 6. Considering the claim of the Petitioner that the works were executed way back in the year 2022 and since more than three years have elapsed, the writ petition is disposed of with the following direction that: (1) The work Bills shall be examined by the Expert Committee so constituted and a report shall be submitted to the concerned within a period of four months for taking further action. (2) If the work bills submitted by the Petitioner are found to be genuine, the Respondents are directed to disburse the amount to the Petitioner within a period of six weeks thereafter.
