Heard learned counsel for the petitioners and learned State Counsel for opposite parties no.1 to 3. In view of order proposed to be passed issuance of notice to opposite parties no.4 to 7 stands dispensed with. Present petition is being filed challenging the order dated 18.02.2025 whereby appeal preferred against the petitioner under section 11 (1) of the U.P. Consolidation of Holdings Act has been transferred from Bahraich to Varanasi. Learned counsel for petitioner submits that distance between Bahraich and Varanasi is substantial and it would be seriously inconvenient for the petitioner to pursue the matter. Considering submissions advanced by learned counsel for petitioners, without interfering in the impugned order, liberty is granted to the petitioner to file an application seeking recall of the order dated 18.02.2025 indicating the difficulties which would be faced by him in transfer of the case. The application is to be decided by opposite party no.1, i.e., Director of Consolidation, UP, Lucknow after affording opportunity of hearing of all concerned and may also consider transfer of case to a nearby district. The aforesaid decision shall be taken within a period of six weeks from the date application for recall is filed along with certified copy of this order. This time frame shall be subject to co-operation of the petitioner in early disposal of the application. With the aforesaid directions, petition stands disposed of.
