GP FOR REVENUE The Court made the following: THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO:8122/2025 ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking following relief: “to issue a Writ of Mandamus or any other appropriate writ, order or direction declaring the inaction of the Respondents in conducting the survey and demarcation of the Petitioners’ land to an extent of Ac.12-00 cents in Survey No.334-B2 situated in Garudapuram Village,Kalyanadurgam Mandal,Anantapur District as illegal, arbitrary and in violation of the Petitioners’ constitutional rights under Articles 14, 21 and 300-A of the Constitution of India and consequently direct the Respondents to conduct survey and demarcation of the Petitioners land to an extent of Ac.12-00 cents in Survey No.334-B2 situated in Garudapuram Village, Kalyanadurgam Mandal, Anantapur District with proper identification of the boundaries and pass such other order or orders….” 2. Heard learned counsel for the petitioners and learned Government Pleader for Revenue for the respondents. 3. Learned counsel for the petitioners submits that the petitioners’ father purchased an agricultural land admeasuring to an extent of Ac.12.00 cents in Sy.No.334-B2 situated at Garudapuram Village, Kalyanadurgam Mandal, Anantapur District vide a registered document dated 19.08.1988. Since then, the petitioners along with their family members are in joint possession and enjoyment of the subject property. While so, the neighbouring land owners are trying to encroach the petitioners’ land, for which, petitioners herein made several representations to respondent Nos. 2 to 5 requesting to conduct survey and to demarcate the petitioners’ subject land. But the respondents did not choose to consider the said representation. Again, petitioner No.3 submitted a representation dated 01.08.2024 to the respondent No.4 seeking to conduct survey and demarcate the land in question within reasonable time. Even after receipt of the said representation, the respondents herein neither considered the same nor issued any proceedings. Moreover, while submitting online application requesting the respondents for conducting survey, for the reasons best known to them, the Village Revenue Officer is refusing to accept challan fees. Aggrieved by the same, the petitioner preferred the present writ petition. 4. On the other hand, learned Government Pleader for Revenue submits that in order to conduct survey and to demarcate the petitioners’ land, the petitioners herein have to make an appropriate F-line application to respondent No.4 through Mee-seva by paying requisite fee. Due to the lack of proper applications, the petitioners’ land cannot be surveyed based on the representation submitted by the petitioner. He further submits that let there be a direction to the petitioner to submit a fresh F-line application seeking to conduct survey and to demarcate the subject land through Mee-seva/ AP Online/ Village Secretariats by paying requisite fee. On receipt of such application, the respondents will consider the same, within a reasonable time. If the said application was not accepted by the portal, the petitioners are directed to submit a manual application to respondent No.4 seeking to conduct survey and to demarcate the subject land. On receipt of such application, the respondents will consider the same, within a reasonable time. 5. Having regard to the submissions made by the learned counsel for the petitioners and learned Government Pleader for the respondents and on perusal of the material placed on record, this Court is of the considered view that the present writ petition can be disposed of, directing the petitioners to make an appropriate F-line application seeking to conduct survey and to demarcate the subject land of the petitioners through MeeSeva/ AP Online/ Village Secretariat and on payment of requisite fee along with all the required documents, within a period of two (02) weeks from the date of receipt of a copy of this order. On receipt of such application, the respondents are hereby directed to conduct survey and demarcate the subject land of the petitioners, after serving notices to all the parties concerned in compliance of the Andhra Pradesh Survey and Boundaries Act, 1923, within a period of three (03) months, thereafter. Further, if the said application through mee-seva is not accepted, the petitioners are at liberty to submit a manual representation/ application to the respondents ventilating their grievance by attaching unsuccessful F-line application particulars, within a period of two (02) weeks from the date of receipt of a copy of this order. On receipt of such manual application, the respondents are directed to consider the same and to conduct survey and demarcate the subject land of the petitioners, after serving notices to all the parties concerned in compliance of the Andhra Pradesh Survey and Boundaries Act, 1923, and pass appropriate orders, in accordance with law, within a period of three (03) months, thereafter. 6. With the above directions, the writ petition is disposed of. No costs.
