The petitioner has been made accused in connection with Bistupur P.S. Case No.249 of 2021 corresponding to G.R. Case No.327 of 2025 registered for the offence punishable under Sections 420, 406, 467, 468, 471, 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused persons ensured impersonation of the owner of the land by creating forged and fake sale deed and cheated the informant and embezzled huge amount of money by identifying one Budheshwar Mahato of village Singpur as Samrendra Choudhary-who is the real owner of the land in question. It is next submitted that the allegation against the petitioner is false. It is then submitted that a panchayati was held wherein Budheshwar Mahato admitted that he has created forged document. It is then submitted that the co-accused has already been granted bail; in this respect, the learned counsel for the petitioner draws attention of this Court towards page No.17- 18 of the brief which is the copy of the certified copy of the compromise petition filed by the informant and the co-accused person in the court of learned Chief Judicial Magistrate, Jamshedpur. It is then submitted that the petitioner has been in custody since 18.12.2024 as is evident from para-19 of the instant bail application. It is further submitted that the petitioner has no
criminal antecedent as mentioned in para-20 of the instant bail application. It is lastly submitted that the petitioner undertakes to co-operate with the trial of the case. Hence, it is submitted that the petitioner be released on bail.
Learned Addl.P.P. appearing for the State opposes the prayer for bail of the petitioner.
