The petitioner has preferred the present petition inter alia with the following prayer:- "A. Issue a writ, order or direction in the nature of mandamus directing the District Basic Education Officer, District Shamli/Respondent No. 3 to pay interest on the delayed payment of gratuity from the date of entitlement to date of actual payment of gratuity in favour of the petitioner within a specified period as may be directed by this Hon'ble Court. B. Issue a writ, order or direction in the nature of mandamus commanding/directing the District Basic Education Officer, District Shamli,/Respondent no. 3, to consider and decide the grievance of the petitioner within stipulated period as fixed by this Hon'ble Court." 2. Today when the matter is taken up Sri Durga Shankar Mishra, learned counsel appearing on behalf of petitioner placed before this Court a copy of the representation submitted by the petitioner before the Basic Education Officer, Shamli/Respondent no. 3 which according to the petitioner was received in his office on 25.11.2022, copy of the same is also appended. On the basis of the aforesaid it is argued that the petitioner is entitled for the interest of late payment as per the law laid down in case of Usha Rani versus State of U.P. and 6 others passed in Writ A No.17399 of 2019 decided on 7.11.2019. 3. On the other hand, it is argued by contesting-respondent that the concerned authority will take decision in the representation which is alleged to be submitted by the petitioner on 25.11.20255 expeditiously. 4. Heard learned counsel for the parties and perused the record. 5. In the facts and circumstances of the case, the present petition is disposed of directing the Respondent No.3 to take decision in the matter most expeditiously and preferably within a period of six weeks from the date of production of certified copy of this order.
