POONACHA ORAL ORDER Learned counsel for the petitioner submits that the affidavit in terms of the order dated 12.11.2013, has been filed on 09.07.2014, a copy of which is annexed as Annexure-F to C.A. No.1/2025. In the said affidavit, the deponent has stated the total value of the movable property was ₹2,86,88,438/- and the stamp duty payable was ₹5,73,769/-. It is further submitted that the stamp duty was paid on 12.09.2014. A copy of e-stamp paper dated 12.09.2014 for the said sum of ₹5,75,000/-, has been placed on record vide memo dated 19.02.2025. 2. It is the submission of learned counsel for the petitioner that the affidavit of schedule of assets in Form-42 was filed and the stamp duty was also paid within the requisite time. Further, payment of the stamp duty was not brought to the notice of the Court. In view of the fact that the petitioner has filed the requisite affidavit in terms of the order dated 12.11.2013 and has also paid the stamp duty, the order dated - 3 - NC: 2025:KHC:16896 CA No. 1 of 2025 IN COP No.277 of 2012 C/W COP No.278 of 2012 13.12.2023 recalling the order dated 30.10.2013 is hereby recalled.
