This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No. 148/2024 registered at Police Station Farasgaon District - Kondagaon (C.G.) for the offence punishable under Section 179, 3(5) of Bharatiya Nyaya Sanhita (for short ‘BNS’). AKHILESH KUMAR DEWANGAN Digitally signed by AKHILESH KUMAR DEWANGAN 2 2. Case of the prosecution, in brief, is that on October 28, 2024, the applicant/accused was found transporting a blue-black Fashion Pro motorcycle without a number plate, carrying a red backpack containing counterfeit notes worth Rs.1,10,000/- in denominations of Rs.500/-. The actions of accused are considered a serious offense, as he has caused economic harm to the Indian economy and the public. Thereafter, aforesaid offence has been registered against the applicant and subsequently he was arrested. Hence, the bail application. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He further submit that the allegation against the applicant that the bag which was carried by the applicant contained Rs.1,10,000/- in counterfeit currency in denominations of Rs.500/-, but the same does not belongs to the applicant, further charge-sheet has been filed in present case and the applicant is in jail since 28.10.2024, trial is likely to take some time for its conclusion. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application and submits that the charge-sheet has been filed in the present case before the competent Court. She further submits that the counterfeit currency of Rs.1,10,000/- recovered from the bag which the applicant was carried, further there is Forensic Science Laboratory report which shows that the notes were found to be counterfeit currency, therefore, he is not entitled for grant of 3 bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy and the fact that the counterfeit currency of Rs.1,10,000/- in denominations of Rs.500/- recovered from the bag which the applicant was carried, further there is Forensic Science Laboratory report which shows that the notes were found to be counterfeit currency to which the applicant has failed to provide any plausible explanation, as such, without expressing any opinion on the merits of the case, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant-Rajesh Sori, involved in Crime No. 148/2024 registered at Police Station Farasgaon District - Kondagaon (C.G.) for the offence punishable under Section 179, 3(5) of BNS, is rejected. 7.
