HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR (Through Virtual Mode) RP No. 99/2025 in CCP(S) No. 284/2021 Mushtaq Ahmad Wani & Ors. ….. Petitioner Through: Mr. Molvi Aijaz Ahmad, Advocate Vs Arun Kumar Mehta & Ors. .….Respondents Through: Mr. Faheem Shah, GA CORAM: HON’BLE MR. JUSTICE M A CHOWDHARY, JUDGE ORDER (28.07.2026) 01. The review petitioners, through the medium of this review petition filed under Article 215 of the Constitution of India, seek recalling of the order dated 09.12.2025, passed by this Court in three contempt petitions bearing CCP(S) No. 284/2021; CPSW No. 605/2017 and CCP(S) No. 103/2021, allegedly on a false statement of the learned counsel for the respondents that order/judgment passed by the Single Bench in SWP No. 1936/2020 had not been implemented and the same had not been stayed, with regard to which, contempt petition had been filed by the review petitioners before this Court. However, on a statement made by the learned counsel for the respondents on 09.12.2025, all the aforesaid contempt petitions were disposed of, with liberty to the petitioners to Supplementary List-1 Serial No. 02 2 RP No. 99/2025 In CCP(S) No. 284/2021 move afresh, after the outcome of the LPAs Nos. 105/2021 and 156/2021. 02. It has been fairly conceded by the learned counsel for the respondents, that the LPAs were against the cognizance order passed in contempt petition bearing CCP(S) No. 284/2021 and not against the order passed in the writ petition SWP No. 1936/2020 and under this confusion, his statement was made, whereupon the order sought to be impugned was passed. 03. In view of these peculiar facts, the review petition is allowed and the order dated 09.12.2025, is recalled and the contempt petitions bearing CCP(S) No. 284/2021; CPSW No. 605/2017 and CCP(S) No. 103/2021, are restored to their earlier numbers for further proceedings. 04. The aforesaid contempt petitions shall be listed before the appropriate Bench on 11.08.2026. 05. This review petition is, accordingly, disposed of. (M A CHOWDHARY) JUDGE JAMMU 28.07.2026 SUNIL
