Ibohal, learned counsel appearing for the petitioner and Mr. Th. Vashum, learned GA appearing for the respondents. At the outset, the counsel for the petitioner submitted that during the pendency of this writ petition, the petitioner filed an application registered as MC(WP(C)) No. 259 of 2026 whereas it has been averred amongst others that the petitioner is going to retire from service on attaining the age of superannuation w.e.f. 31-03-2026. It has also been averred that the authorities have already granted two ACPs to the petitioner on his completing service of 10 years and 20 years respectively as provided under the Modified Assured Career Progression Scheme (MACPS). The learned counsel appearing for the petitioner submitted that the petitioner will be satisfied if the present writ petition as well as the connected two applications are disposed of by issuing a direction to the respondents to consider the case of the petitioner for grant of 3rd ACP as provided under the said MACPS within a reasonable period w.e.f. the date he is entitled to receive the same before his retirement from service. Mr. Th. Vashum, learned GA appearing for the respondents fairly submitted that he has received instruction from the authorities that the authorities are in the process of considering the case of the petitioner for grant of 3rd ACP as provided under the said MACPS and that in the event, if the petitioner is entitled to receive the 3rd ACP, the authorities will pass necessary order for granting the same. The learned GA, accordingly, submitted that the present writ petition as well as the connected two applications can be disposed of as prayed for by the learned counsel appearing for the petitioner. Considering the submission made by the learned counsel appearing for the parties, this court is of the considered view that it will be in the interest of justice to issue the following directions:- (i) The respondents, more particularly, the respondents No. 1, 2 and 3 are hereby directed to consider the case of the petitioner for grant of 3rd ACP as provided under the aforesaid MACPS. In case the authorities found that the petitioner is entitled to grant of 3rd ACP, the respondents No. 1, 2 and 3 -2- WP(C) No. 823 of 2025 & ors. Contd…/- are directed to issue necessary order for grant of 3rd ACP to the petitioner; (ii) It is made clear that the grant of 3rd ACP to the petitioner should be w.e.f. the date he is entitled to receive the same in any case, the effective date should be prior to the date the petitioner retired from service on attaining the age of superannuation; and (iii) The whole process should be completed within a period of four months from today.
