Neutral Citation No. - 2025:AHC-LKO:17530 Court No. - 6 Case :- WRIT - C No. - 2835 of 2025 Petitioner :- Mrs. Vandana Parmeshwar Tripathi And 20 Others Respondent :- State Of U.P. Thru. Secy. Deptt. Of Nagar Vikas U.P. Lko. And 7 Others Counsel for Petitioner :- Sunil Kumar Mishra,Atul Kumar Chauhan Counsel for Respondent :- C.S.C.,Ratnesh Chandra Hon'ble Pankaj Bhatia,J.
1. Heard learned counsel for the petitioners and Shri Ratnesh Chandra, learned counsel for the respondents.
2. The present petition has been filed challenging the orders of demolition passed against the petitioner on 01.06.2023, the
order of dismissal of appeal passed on 13.04.2023 and is consequent order passed on 28.01.2025 directing that in case the petitioner does not remove the appending construction himself, the force will be used to demolish the same.
3. The main contention of learned counsel for the petitioner is that the petitioner had moved a compounding application on 09.08.2023, seeking to get the construction compounded, which application is pending before the respondent- authorities and no
order has been passed thereupon.
4. Considering the fact that it is admitted that a compounding application has been filed and the same has not been disposed of, present writ petition is disposed of directing the respondent - authorities to pass order on the compounding application filed by the petitioner in accordance with law with all expedition. The order passed on compounding application shall supersede the two orders of demolition as impugned in the present petition.
5. It is made clear that till disposal of the compounding application, no step for demolition shall take place.
