Present application under Section 483 Cr.P.c. has been preferred to issue an appropriate order or direction commanding the learned court of Additional Chief Judicial Magistrate (Court No.19), Barabanki, to decide the instant case bearing Case No.1760 of 2016 (State of U.P. versus Vijaynand Maurya and Others), arising out of Case Crime No.299 of 2015 under Sections 342, 406, 323, 506, 420, 325 I.P.C. relating to Police Station - Safdarganj, District - Barabanki, which is presently pending before the Learned Court of Additional Chief Judicial magistrate (Court No.19), Barabanki, expeditiouisly within a time frame. Learned A.G.A. has raised preliminary objection regarding maintainability of the present application and has submitted that from the admitted case of the applicant the charges have been framed on 13.12.2024 and within less than three months of framing of the charges the present application has been filed under Section 483 Cr.P.C. for early disposal of the pending case, which is premature. At this stage, learned counsel for the applicant has submitted that the applicant may be permitted to withdraw the present application as dismissed as not pressed with liberty to file afresh at the appropriate stage. With the aforesaid liberty, the present application u/s 483 Cr.P.c. is dismissed as not pressed. Order Date :- 7.7.2025 S.
