1. This is an application filed by the appellant seeking release of the deposited amount and for withdrawal of the appeal.
2. Issue notice of this application to the respondent.
3. Mr. Adarsh Sharma, Advocate accepts notice on behalf of the respondent.
4. In the application, it has been submitted that during the pendency of the appeal, the applicant/appellant had applied for availing the benefit of One-Time Amnesty Scheme floated by the Board for amicable settlement of the dispute. It has been further submitted that after Serial No. 01

availing the benefit of the said scheme, the appellant/applicant has deposited the requisite amount with the respondent-Board in terms of the settlement arrived at in the light of the said scheme.
5. Under these circumstances, the applicant/appellant seeks permission to withdraw the present appeal besides seeking release of amount deposited with this Court pursuant to interim order dated 02.02.2015, whereby operation of the impugned order was stayed.
6. The aforesaid facts have not been disputed by the learned counsel appearing on behalf of the respondent.
7. In view of the above, the application is allowed and the appeal filed by the appellant/applicant is dismissed as withdrawn. The amount deposited by appellant/applicant pursuant to order dated 02.02.2015 passed by this Court is directed to be released in favour of the appellant/applicant. The Registrar Judicial is
directed to release the said amount along with interest that may have accrued thereon in favour of the applicant/appellant by transferring the same to his bank account.
