The petitioner has been made accused in connection with Jarmundi P.S. Case No.61 of 2024 corresponding to G.R. No.51 of 2025 registered under Sections 302, 201, 435, 427 & 34 of the Indian Penal Code and later on Section 27 of the Arms Act was added vide order dated 15.06.2024. The learned senior counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner, in furtherance of common intention with the co-accused persons, has committed the murder of Mohan Das and caused disappearance of the evidence of murder. It is submitted that the allegation against the petitioner is false. It is next submitted that the petitioner has been implicated in this case only because of suspicion and the fact that his brother was having land dispute with the deceased- Mohan Das. It is further submitted that another reason for suspecting the petitioner is that the petitioner was having frequent conversation over mobile phone with the deceased on the date of occurrence. It is also submitted that though charge-sheet has been submitted in this case but charge has not yet been framed. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will not annoy or disturb the informant and other witnesses of the case during the trial of the case. It is next submitted that the petitioner has been in custody since 29.10.2024 as has been mentioned in para-26 of the bail application. It is lastly submitted that the co- accused persons have already been admitted to bail by this Court vide order dated 29.04.2025, in B.A. No. 3358 of 2025. Hence it is submitted that the petitioner be released on bail. Learned Addl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Dumka in connection with Jarmundi P.S. Case No.61 of 2024 corresponding to G.R. No.51 of 2025 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and he will not annoy or disturb the informant and other witnesses of the case during the trial of the case.
