THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.3309 OF 2025 ORDER:
1. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State.
2. The learned counsel for the petitioner submits that the petitioner was arraigned as A.2 in Crime No.9 of 2025 of Proddatur I Town Police Station, Kadapa District.
3. The learned counsel for the petitioner submits that the petitioner is the mother of A.1. It is further submitted that on account of marital disputes, the petitioner was falsely implicated in the present crime. There are no specific allegations against the petitioners. The learned counsel for the petitioner seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Proddatur I Town Police Station, Kadapa District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 insofar as the petitioner is concerned, for the purpose of investigation in connection with Crime No.9 of
2025.

5. Accordingly, the criminal petition is disposed off.
