The present appeal has been filed through legal aid, against the impugned judgment of conviction and order of sentence dated 30.12.2024 passed by the learned Additional Sessions Judge, Dongargarh, District Rajnandgaon in S.T. No. 10/2023 by which the appellant has been convicted and sentenced by the trial court and it has been brought to the notice that the appellant has already filed an appeal as CRA No. 350 of 2025 which was last listed on 06.03.2025 and this court has granted three weeks time to State to file the reply. 2. Learned Counsel for the appellant would submit that since the said CRA No. 350 of 2025 which was pending, therefore, he may be permitted to withdraw the present appeal. 2 3. In view of the above submission, the present appeal which is second in nature, is not maintainable. He is permitted to withdraw this appeal. 4. Ordered accordingly, the appeal being redundant is dismissed as withdrawn. 5.
