Pandey, learned counsel for the petitioner and Mr. Om Anand, learned Standing Counsel for the State- respondents. 2. The instant writ petition has been filed for the following relief:- "(i) Issue a writ, order or direction in the nature of mandamus commanding to the respondent no. 2 i.e. Consolidation Officer, Final Record, Pharenda, Maharajganj to decide the case bearing Case No.0925 of 2023 computerized case no.202354054752040925 (Barkhu & others Vs. State of U.P.) under section 9A(2) of U.P. Consolidation of Holdings Act, pending in the court of respondent no. 2 since 10.02.1995, within stipulated period fix by this Hon'ble Court." 3. This Court on 5.2.2025 directed the Consolidation Officer, Final Record, Pharenda, Maharajganj to submit report about the status of pending proceeding. 4. In compliance of the order of this Court, instructions/report has been sent by Consolidation Officer that evidence of the parties is going on and matter shall be decided expeditiously, in accordance with law. 5. Considering the instructions sent by respondent no.2/ Consolidation Officer, Final Record, Pharenda, Maharajganj, without expressing any opinion on the merits of the issue, the instant petition is disposed of finally directing the respondent no.2 to decide the aforementioned title proceeding under Section 9A(2) of U.P. Consolidation of Holdings Act, in accordance with law, expeditiously and preferably within a period of one months from the date of production of certified copy of this order.
