The learned counsel for the petitioner submits that the petitioner is arraigned as accused in Crime No.30 of 2025 of Prakash Nagar Police Station, East Godavari District, registered for the alleged offence under Section 329(4), 303(2), 324(2), 351(2) read with 3(5) Bharatiya Nyaya Sanhita. 3. The learned counsel for the petitioner submits that the petitioner was falsely implicated in the case, and there is no specific allegations against the petitioner. The learned counsel further submits that the offences alleged against the petitioner is punishable below 7 years and therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Considering the submissions of the learned counsel for the petitioner, the Investigating Officer/Station House Officer, Prakash Nagar Police Station, East Godavari District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, for the purpose of investigation in connection with Crime No.30 of 2025, in so far as the petitioner is concerned. 5. Accordingly, the Criminal petition is disposed off.
