This petition purportedly in public interest has been filed by the petitioner inter-alia seeking direction to the respondent nos. 2 to 4 to take action against those purportedly obstructing holding of annual Urs Mubarak ceremony at Bengali Shah Warsi Mazar situated at village and post Sarwanpur, Pargana - Pahadapur, Tehsil - Colonelganj, District - Gonda. 2. A perusal of the record indicates that in previous year, permission for holding annual Urs has been granted to one Siraz, the said Siraz has already filed a suit before the Civil Judge (Junior Division), Gonda inter-alia seeking permanent injunction against the purported trouble makers and the said suit continues to remain pending, filing of the present Public Interest Litigation during the pendency of the suit before the competent civil court, cannot be countenanced. 3. No case for entertaining the present Public Interest Litigation is made out and the same is, therefore, dismissed.
