Petitioner was granted recognition by All India Council for Technical Education (AICTE) for running MBA Course at Dehradun in 2010. Petitioner was not able to run the Institute, therefore, an application was filed by petitioner before AICTE seeking permission to close the Institute. The MBA Course is now suspended, after 2017. 5. By means of this writ petition, petitioner has sought the following reliefs:- “I. Issue a writ, order or direction in the nature of mandamus directing the respondents to release the FDR amount of the petitioner along with accrued interest. II. Issue a writ or writs or directions particularly in nature of Mandamus directing the respondents to comply within a specified time frame to ensure prompt payment of the FDR as well as the interest accrued on it as per Rules.” 6. In sum and substance, petitioner wants refund of `15,00,000/-, which is pledged in the name of AICTE. 7. Mr. Yogesh Pacholia, learned counsel appearing for AICTE was granted time to get 2025:UHC:9106 instructions. Today, on instructions, he submits that petitioner has not furnished the following documents:- i. No Objection Certificate from State Government. ii. No Objection Certificate from Affiliating University. iii. Resolution of the Society/Trust seeking closure of the course. 8. Learned counsel for petitioner submits that petitioner will submit the aforesaid documents within three weeks, along with fresh application for release of FDR. 9. Mr. Yogesh Pacholia, learned counsel appearing for AICTE submits that the Competent Authority in AICTE shall process the application within six months of its receipt as per Approval Process Handbook. 10. The writ petition is, accordingly, disposed of with liberty to petitioner to make fresh application for release of the FDR within three weeks from today. Petitioner shall furnish all the requisite documents with his application. If such application is made within stipulated time, AICTE shall process the same and pass appropriate order, as per law, within six months.
