Heard learned Counsel for the petitioner as well as learned Standing Counsel. 2. The present petition has been filed with the following prayer: "a. a writ, order or direction in the nature of mandamus, commanding the opposite party no. 3 to remove the illegal encroachment/possession on public utility land situated at Village-Bharthauli, Jigana Bazar, Pargana Tehsil Sadar Gonda and District Gonda i.e. Gata No. 113, having area of 0.1420 hectare which is recorded as "Pond" and Gata no. 111 having area of 0.0160 hectare which is recorded as "Mukhya Marg" (Main Road), and Gata no. 53 having area of 0.0650 hectare which is recorded as "Khad Gadha" and Gata no. 51 having area of 0.1170 hectare which is recorded as "Khalihan" and Gata no. 1 having area of 0.0570 hectare and Gata no. 19 having area of 0.1380 hectare which is recorded as "Nala" in the revenue extract of village concerned. b. a writ, order or direction in the nature of mandamus, commanding the opposite parties no.3 and 4 to decide the complaints/representations of petitioner in relation to illegal encroachment of public utility land of Village-Bharthauli, Jigana Bazar, Pargana Tehsil Sadar Gonda and District Gonda i.e. Gata No. 113, having area of 0.1420 hectare which is recorded as "Pond" and Gata no. 111 having area of 0.0160 hectare which is recorded as "Mukhya Marg" (Main Road), and Gata no. 53 having area of 0.0650 hectare which is recorded as "Khad Gadha" and Gata no. 51 having area of 0.1170 hectare which is recorded as "Khalihan" and Gata no. 1 having area of 0.0570 hectare and Gata no. 19 having area of 0.1380 hectare which is recorded as "Nala" in the revenue extract of village concerned within specific time frame preferably within a month." 3. Considering the fact that the petitioner has an adequate efficacious remedy under the U.P. Revenue Code, the present petition is disposed off directing the petitioner to file an appropriate application before the respondent no.4, who shall take action in accordance with law on the application so filed within the time as prescribed under the statute.
