1. Heard Mr. A. Paramanik, learned counsel for the petitioners. Also heard Mr. R. R. Kaushik, learned Additional Public Prosecutor. Learned Amicus Curiae was not found on call. 2. This application under Section 483 of BNSS, 2023, has been filed by the petitioners, namely, Uday Boro and Anirudha Rabha, who are detained behind bars since 09.04.2025 for 92 days. 3. Learned counsel for the petitioners has submitted that petitioners are detained behind bars for 92 days, and the maximum statutory period of detention as provided under Section 187 of BNSS, 2023, is 90 days in this case. Hence, they may be allowed to be released on completion of the maximum statutory period of detention. 4. On the other hand, the learned Additional Public Prosecutor has produced the case diary and has submitted that apparently, it appears that the charge sheet has not been laid in this case and the statutory period of detention as provided under Section 187 of BNSS, 2023, is over. 5. Considering the submissions made by the learned counsel for both sides as well as considering the fact that the statutory period of detention provided under Section 187 of BNSS, 2023 is over in this case, both the above-named petitioners are allowed to go on bail of Rs.
50,000/- each with one surety of like amount, subject to the
Page No.# 3/3 satisfaction of the learned Special Judge, POCSO, Goalpara, with the following conditions:- (i) The petitioners shall appear before the Investigating Police Officer within 10 (ten) days from the date of this order and shall co-operate with the investigation; and (ii) The petitioners shall not directly or indirectly make any inducement, threat, or promise to the informant or to any other person who may be acquainted with the facts of the case so as to dissuade such person from disclosing such facts before the Investigation Officer or to any Court. 6.
