"As per your request vide ref(1) above, please find below the details regarding Power of Allarney No.411/2000 & 277/2017 which was furnished by District Registrar (General), Ernakulam. Power of Attorney No 277/2017 was registered at Sub Registry Office, Emakulam on 21/07/2017. This document was seen executed by Cherparambathu Radhakrishna Menon alias C.R.Menon in favour of Sri Sethupathy. So/. Arumugham. Power of Attorney No 411/2000 was registered at Sub Registry Office Ernakulam. This document was seen executed by one Sri Chandy & Sunitha Joby in favour of Srl. Subin. On examining the document, it seems that Sri. C.R.Menon & Sri.P.T.Thomas has no connection with the above document. Even though the respondent had conducted enquiry under Section 77A, the respondent is not having power under 77A since it was struck down and then consequently it has to be quashed. But the allegation against the petitioner and his vendor is very serious. Therefore, this Court is restraining the petitioner from further alienating the property. The third respondent has already filed a suit in O.S.No.611 of 2025 on the file of the Principal Sub Judge, Dindigul and the same is pending in which the petitioner also arrayed as party. Therefore until the disposal of the suit, the parties shall not encumber the property. With these directions, the impugned order is quashed. 4.Accordingly, this Writ Petition is allowed. There shall be no order as to costs.
