Neutral Citation No. - 2025:AHC-LKO:14822-DB Court No. - 2 Case :- WRIT - C No. - 2419 of 2025 Petitioner :- M/S Nav Jyoti Scientific Sales Corporation Thru. Prop. Yatendra Kumar Singhal Respondent :- State Of U.P. Thru. Prin. Secy. Ministry Of Health And Family Welfare Lko.And 3 Others Counsel for Petitioner :- Ramesh Chandra Pathak,Mohit Pathak Counsel for Respondent :- C.S.C.,Shubham Tripathi Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. The petitioner had earlier filed a writ petition bearing Writ- C No.521 of 2022 challenging the order dated 08.12.2021. Copy of the said order has not been annexed with the writ petition, but the same has been placed before us by learned Standing counsel for KGMU, Lucknow. By the said order, the claim of the petitioner for payment was declined and petitioner was blacklisted. On a challenge being raised, the said order was set aside only to the extent of blacklisting and not with regard to other subject matters decided by the said order dated 08.12.2021. Accordingly, on 19.05.2022, a fresh order was passed by the Secretary, KGMU Lucknow modifying the order dated 08.12.2021 in deference to the order of this Court dated 01.02.2022, therefore, this writ petition for the relief claimed is not maintainable as it is for payment of the dues, which has already been decided on 08.12.2021 and attained finality in view of the judgment of this Court dated 01.02.2022 wherein this aspect was not interfered and in fact, learned counsel for the petitioner had categorically confined his prayer only to the extent of blacklisting as is recorded therein. After arguing the matter at length, learned counsel for the petitioner says that he may be permitted to withdraw the present writ petition as it appears to have been filed under some misconception and miscommunication of facts. The present petition is dismissed as withdrawn with caution for future. (Om Prakash Shukla,J.) (Rajan Roy,J.)
