Heard learned counsel for the petitioner and perused the record. 2. The present petition has been filed by the petitioner with the following prayer: " WHEREFORE, it is most respectfully prayed that this Hon'ble court may graciously be pleased to direct the Civil Judge (J.D.) Faizabad, Havel to decide the application dated 22.08.2023 filed by the petitioner for clubbing the Regular suit No. 1359/2022(Sanjay Kumar versus Raj Karan) with the Suit No. 80/2023(Raj Karan versus Sanjay which ommissioner Haveli is pending since 2023, and also direct the Civil Judge(J.D.) Faizabad Oath Commissio to decide the Regular suit No. 1359/2022(Sanjay Kumar versus Raj Karan) after clubbing as leading case, which is pending since 2022, as expeditious as possible." 3. Considering the fact that the power is vested in the trial Court by virtue of Order IV-A, the present petition is disposed of directing that the application filed for consolidation of the suit shall be decided in terms of the mandate of Order IV-A with all expedition preferably within a period of one month.
