The petitioners are in custody for about 3 years. Learned counsel for the petitioners submits that the case is based on the principle of “last seen together” and there is no eye witness to the incident. Further detention of the petitioners is not required. The petitioners pray for bail. Opposing the prayer, learned counsel for the State submits that the petitioners were seen to have taken the victim in their motorbike after which dead body of the victim was found. Fingerprints of the petitioners have matched with the specimen of glass particles recovered from the place of occurrence. The earth particles of the place of occurrence also matched with the earth particles found in the wearing apparel of the petitioners. Considering the incriminating material against the petitioners suggests prima facie involvement of the
2 petitioners in the alleged offence, prayer for bail is rejected at this stage. The learned trial Court is directed to take the proceeding to its logical conclusion as expeditiously as possible without granting any unnecessary adjournment to either of the parties, in accordance with law. The application for bail is thus disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
