Neutral Citation No. - 2025:AHC-LKO:26871-DB Court No. - 2 Case :- WRIT - C No. - 2299 of 2025 Petitioner :- Abbas Haider Respondent :- State Of U.P. Thru. Secy. Energy Deptt. Lko. And 3 Others Counsel for Petitioner :- Vijay Kumar Counsel for Respondent :- C.S.C.,Aprajita Bansal Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard Shri Vijay Kumar, learned counsel for the petitioner, learned Additional Chief Standing Counsel for the State and learned counsel holding brief of Ms. Aprajita Bansal,
learned counsel for the Electricity Corporation. Based on inspection conducted on 05.05.2025 a report after serving a copy to the petitioner, has been place before us. According to it, the petitioner is residing in the premises wherein the mother also resides. There are electricity dues on the premises. The report further says that electricity light, fan, switch board and air conditioner were found in the premises. On being asked learned counsel for the petitioner stated that earlier the electricity connection was taken in the name of his mother. Now, the legal position is that if there are any dues on the premises in question, then, first of all, they have to be cleared. Who is liable to clear the dues is another issue with which we are not concerned. If the petitioner wants the connection in his name, then, he will have to ensure that the dues are cleared and he can raise a claim against other occupants if they are also left. The petitioner may do the needful whereupon his application would be considered as per law. With the aforesaid observations/directions, the writ petition is disposed of. . (Om Prakash Shukla,J.)
