Learned counsel for the revisionists has challenged the order dated 16.03.2024 by which an ex-parte order has been passed against respondent-husband and the respondent- husband was directed to pay a sum of ₹35,000/-, per month, to the revisionist as maintenance vide allowing the application under Section 125 of Cr.P.C., passed by learned Judge, Family Court, Haldwani, District Nainital. Revisionists wanted the maintenance granted by the trial court to be enhanced. 4. Learned counsel for the revisionists submits that during pendency of the present criminal revision, an application has been moved by the respondent-husband before the trial court for recalling the impugned order, which has been passed ex-parte. 5. The said application was allowed and the judgment and order impugned in the present criminal revision has been set aside. 6. Learned counsel for the revisionists submits that in the aforesaid background the present criminal revision has rendered infructuous. 7. Accordingly the same is dismissed.
